What is a Professional Fiduciary?

A Professional Fiduciary is a specially designated individual entrusted with the responsibility of making important decisions on behalf of another person, particularly in legal, financial, or estate matters. These roles are essential within estate planning and can encompass various positions such as Executor, Trustee, Conservator, or Agent acting under a Power of Attorney. Each role demands a profound level of trust and responsibility, as the fiduciary is legally and ethically obligated to act in the best interest of the individual they serve.

For example, an Executor manages the estate of a deceased person in accordance with the terms laid out in their will, ensuring that debts are paid and assets are distributed properly. A Trustee oversees the assets within a trust, making careful investment decisions that benefit the trust's beneficiaries. A Conservator is appointed to handle the financial and personal affairs of someone unable to manage their matters. At the same time, an Agent under Power of Attorney makes decisions that align with the principal’s preferences and interests.  Attorney RJ Connelly III is a professional fiduciary who plays a vital role in ensuring that each clients' wishes and best interests are honored while complying with the legal standards mandated by law.

An Ethical and Professional Team

Connelly Law's Fiduciary Department exemplifies the highest standards of compassion, commitment, integrity, and loyalty to our clients. They possess extensive skills, experience, and knowledge invaluable in their roles. Connelly Law offers reliable and proficient support for personal or estate financial management when assistance is required in managing the affairs of individuals unable to do so themselves.

Many families with elderly members opt to appoint our fiduciary team to alleviate the burden on family members. Even the most capable adult children are often fully engaged with work and home responsibilities, and logistical challenges may arise due to distance. Further, some family members may lack the requisite skills or present potential conflicts with siblings or other relatives, making them unsuitable for fiduciary responsibilities.

The Professional Fiduciary team at Connelly Law is prepared to provide a comprehensive range of services. Whether assisting with everyday bill payments or ensuring the accurate and efficient execution of a loved one's will and estate directives, our services are designed to meet diverse needs.

At Connelly Law, our fiduciary team understands the importance of responsible asset stewardship for families across generations. "Our Representative Payee services use the beneficiary’s Social Security and/or SSI payments to pay for his/her current needs and to maintain accurate records for the beneficiary and others as required. This ensures that necessities like rent, utilities, and other bills are paid and current for someone who has difficulty in managing money.  We are responsible for determining your needs and the best way to use your funds to meet those needs."
